ELIGIBILITY: The Touchdown in Vegas Promotion (“Promotion”) is open only to individuals who are legal residents of Ontario and who are twenty-one (21) years of age or older at the time of entry (unless otherwise excluded by Sponsor in accordance with applicable law), playing physically in Ontario; (for those entering via the Wager method (as described in Section 4 below)), and have an active, KYC verified BetMGM Sportsbook account (“Sportsbook Account”). Proof of residency and age may be required. Creating a Sportsbook Account at https://sports.on.betmgm.com/en/sports is free. By submitting your information and creating a Sportsbook Account, however, you will be required to agree to Sponsor’s Privacy Policy and Terms of Service, and you will be required to create an MGM Rewards Program (“Program”) account and agree to the Program terms and conditions and the Privacy Policy of MGM Resorts International. If you do not agree to Sponsor’s Privacy Policy and Terms of Service, you cannot create a Sportsbook Account or participate in this Promotion. If you do not agree to the Program terms and conditions and the Privacy Policy of MGM Resorts International, you cannot participate in this Promotion. Employees, officers, directors, members and representatives of Promotion Entities (defined below), members of these persons immediate families (spouse, parents, siblings and children and each of their respective spouses, children and siblings), and persons living in the same households of each of the above (whether legally related or not) are ineligible to participate in this Promotion or receive a prize. Sponsor additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Promotion for any reason, in its sole discretion, including based on your wagering patterns or wagering history. Additionally, any individual with a Sponsor (as defined below) account on any product in one or more jurisdictions where Sponsor operates that has been closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this Promotion even where such entrant may seek entry in this Promotion through an active account in another jurisdiction. “Promotion Entities,” as referenced herein, shall include Sponsor, MGM Resorts International Operations, Inc., and each of their respective parent, subsidiary, and affiliate companies, and administrative, advertising, and promotion agencies, gaming license partners, and any other entity involved in the development, administration, promotion, or implementation of the Promotion. Subject to all applicable federal, state and local laws and regulations. Promotion is void outside the United States and wherever prohibited or restricted by law.

   Weekly drawings will take place five (5) days after the conclusion of each Entry Period. Sponsor’s computer is the official time-keeping device for the Promotion.

4. HOW TO PARTICIPATE: No Purchase Necessary to Enter or Win. For each eligible entry that you submit during an Entry Period (up to 10 entries per Entry Period), you will also automatically receive one (1) entry in the drawing for the Grand Prize Package (unless you are selected as a winner of a Weekly Prize, in which case you will not receive any entries for the Grand Prize drawing). No further steps must be taken. You may enter the Promotion in any of the following ways:
   • “Wager” Method: For each Entry Period, once you have logged into your BetMGM Sportsbook account and opted into the Promotion, you may earn entries by wagering at least one hundred dollars ($100) on The National Football League, to receive an entry (-200 minimum odds). Your wager must be received by Sponsor within the applicable Entry Period in order for it to be an eligible entry for that Entry Period.
   • Alternative Method of Entry (“AMOE”) – Mail-In Entry: Participants may earn TEN (10) entries by providing the Participant’s complete name, street address, city, state, ZIP code, daytime and evening telephone numbers (including area code), Sportsbook Account user ID, and valid email address, on a plain piece of 3.5” x 5” paper, and mailing it in a standard business size envelope to BetMGM Marketing, attn.: “Touchdown in Vegas” Promotion, Harborside Plaza 2, Suite 700, 200 Hudson Street, Jersey City, NJ 07311 each week. For each Entry Period, mail-in entries for such Entry Period must be postmarked on a date that is between (and including the start date and end date of such Entry Period) and received no more than five (5) days after the end date of such Entry Period to be eligible for that Entry Period. The postmark date on mail entries will be considered the date of entry.

   Non-winning entries during a weekly Entry Period will not roll over to subsequent weekly Entry Periods, but, subject to these Official Rules, are eligible for the Grand Prize drawing

   LIMIT: Maximum of TEN (10) entries per person per Entry Period regardless of entry method. Maximum of one hundred and eighty (180) entries per person during the Promotion Period regardless of entry method. Subsequent attempts made by the same individual to submit multiple entries, including by using multiple or false contact information, accounts or otherwise, may result in the entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with these Terms & Conditions may be disqualified from the Promotion at Sponsor’s sole and absolute discretion. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. All materials submitted by participants become the property of Sponsor and, unless otherwise indicated herein, will not be returned. For purposes of this Promotion, an online entry is “received” when Sponsor’s Website’s servers record the entry information, and a mail-in entry (if applicable) when such entry is physically received by Sponsor at the address provided herein. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Promotion. The Website’s database clock will be the official timekeeper for this Promotion. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Terms & Conditions or other instructions of Sponsor may be disqualified. All entrants submitting materials/content as part of the Promotion will be non-exclusively licensing (with the unlimited right to sublicense) to Promotion Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof.

5. WINNER’S SELECTION AND NOTIFICATION: The drawing for each weekly Entry Period will take place five (5) days after the conclusion of such Entry Period. In each such drawing for Entry Periods 1- 17, three (3) potential winners will be selected in a random drawing by representatives of Sponsor from among all eligible entries received during each respective Entry Period. In each such drawing for Week 18, seven (7) potential winners will be selected in a random drawing by representatives of Sponsor from among all eligible entries received during that Entry Period. For each Entry Period, the odds of winning the Prize associated with such entry Period depends on the total number of eligible entries received for such Entry Period. The drawing for the Grand Prize Package will take place on or about January 12^th, 2024 where one (1) potential Grand Prize winner will be selected in a random drawing by representatives of Sponsor from among all eligible entries received during the Promotion Period (i.e., during all eighteen (18) weekly Entry Periods). The odds of winning the Grand Prize depend upon the total number of eligible entries received for the Grand Prize drawing during the Promotional Period. Each selected potential winner will be notified via email and/or telephone. Sponsor is not obligated to leave a voice, recorded, or another message. Each selected potential winner will be required to respond to the notification within five (5) business days of the date and time notification was sent/attempted by Sponsor, with the required information or prize will be forfeited. Each selected potential winner must continue to comply with all terms and conditions of these Terms & Conditions and winning is contingent upon fulfilling all requirements.

   PLEASE NOTE THAT EVEN IF YOUR ENTRY IS IDENTIFIED AS A POTENTIAL WINNER YOU HAVE NOT YET WON A PRIZE. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, AND MUST MEET ALL ELIGIBILITY REQUIREMENTS AND THE TERMS OF THESE TERMS & CONDITIONS BEFORE AN ENTRANT WILL BE CONFIRMED AS A WINNER AND A PRIZE WILL BE AWARDED.

   In order to be verified as a winner and receive the Prize, potential winner must be in good standing with MGM Resorts and Sponsor including without limitation being current on all accounts and not previously excluded from any properties or services, and not be excluded under any applicable state regulations. If requested by Sponsor, potential winner must be willing to voluntarily submit to and complete a background check as a condition of continued eligibility.

   The potential winner may be required to sign and return an Affidavit of Eligibility, Liability, & Publicity Release (“Affidavit”) and an IRS W-9 form to Sponsor. If required by Sponsor, these documents will be sent out to the potential winner by email along with instructions on to how to return them to Sponsor. In addition, each potential winner’s guest, if any and as applicable, may (in Sponsor’s sole discretion) be required to execute and return a release of liability as directed in order to participate in the prize as winner’s guest. Each potential winner and his or her guest, if any and as applicable, may be required to provide his/her U. S. Social Security Number for tax purposes. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of any alternate potential winner. Sponsor may share the potential winners’ names and contact information with Promotion Entities and/or any prize provider, as applicable, if necessary. Upon completion and acceptance of the Affidavit and once a potential winner provides the necessary proof of travel documents, then he or she will be declared a Winner.

   In Sponsor’s sole discretion, a selected potential winner may be disqualified (and may forfeit his/her prize), and an alternate potential winner may be selected in accordance with these Terms & Conditions from among the remaining eligible entries if such selected potential winner (i) is unreachable or does not timely respond to any communication from Sponsor (or its designee) (or if a winner notification is returned as undeliverable), (ii) declines or cannot accept, receive or use a prize for any reason, (iii) fails to sign and return the Affidavit within the required time period, and/or (iv) does not comply with these Terms & Conditions or is otherwise found to be ineligible. Forfeited prizes may not be awarded. In the event that a potential winner is disqualified and/or is unable to satisfy the requirements herein, Sponsor will use reasonable efforts to award the prize to an alternate potential winner (if necessary and time permitting) who successfully meets the requirements to receive a prize but reserves the right to not award the prize after multiple efforts to identify an alternate potential winner (if any) who accepts the prize.

   Notwithstanding anything in these Terms & Conditions to the contrary, Sponsor will have complete discretion over interpretation of these Terms & Conditions, of administration of the Promotion, and of selection/determination of the potential winner(s).Sponsor’s decisions in all matters related to the Promotion are final and binding. Each selected potential winner may, in Sponsor’s sole discretion, be required to show a valid state issued driver’s license, government-issued identification or other identification (subject to Sponsor’s approval) as evidence of identity.

6. PRIZES

   WEEKLY PRIZES: A total of fifty-eight (58) Weekly Prize Packages are offered in this Promotion (each a “Weekly Prize Package”). Each Weekly Prize Package will be awarded to one (1) winner. Each Weekly Prize Package consists of the following elements:

   • $500 in MGM Food & Beverage Credit for use throughout MGM Grand in Las Vegas
   • Three-night (3) stay at MGM Grand in Las Vegas for each Weekly Winner and one (1) guest in a standard double occupancy room, plus daily resort fee, checking-in on Friday February 9th, 2024 and checking out Monday February 12^th 2024.
   • $1,000 in Withdrawable funds for use for travel expenses room, plus daily resort fee.
   • Access to the BetMGM WestFest concert and invitation to the BetMGM The National Football League Watch Party (exact location to be determined for WestFest & Watch Party).

   GRAND PRIZE: A total of one (1) Grand Prize Package is offered in this Promotion (“Grand Prize Package”). This Grand Prize Package will be awarded to one (1) winner. This Grand Prize Package consists of the following elements:

   The Weekly Prize Packages and the Grand Prize Package are collectively known as the “Prizes”.

   Prizes received from this promotion are non-transferable and are subject to availability (as determined by Sponsor in its sole discretion).

   Hotel Stays - In order to be verified as a winner of a hotel stay for the winner and one (1) Guest at MGM Grand, a potential winner and his/her guest must be in good standing with MGM Resorts International (collectively with Sponsor known as “Prize Provider”) including without limitation being current on all accounts and not previously excluded from any properties or services, and not be excluded under any applicable state regulations. If requested by Sponsor, potential winner must be willing to voluntarily submit to and complete a background check as a condition of continued eligibility. Potential Winner acknowledges and agrees that Sponsor and MGM Resorts may share all necessary information collected from or provided by the potential winner for the purposes of administering the promotion, including verifying eligibility and awarding the prize.

   The food and beverage credit is not valid for gratuities. The daily food and beverage credit becomes available upon check-in. Daily food and beverage will not be given and is not valid for use on the day of your check-out. Unused daily food and beverage credit does not accumulate or carry-over to a subsequent calendar day. Food and beverage outlets and outlet hours of operation are subject to availability and/or closures. Unused food and beverage credit will be forfeited.

   Each winner will be required to present a valid government-issued photo identification and valid credit card at the time of check-in to cover incidentals and fees/services not included in the prize. . Verified winners will have until January 31, 2024 to book.

   Entry to MGM Grand requires either (i) the use of face coverings while in public spaces (ii) proof of being fully vaccinated for COVID-19 as per CDC Guidelines and/or (iii) proof of a recent negative COVID-19 test. If an individual is unable to provide the required proof described above, then such individual will not be allowed into MGM Grand. Guests are responsible for all costs and expenses associated with the above requirements including, but not limited to, cost for COVID-19 tests. Guests who have a positive COVID-19 test while at MGM Grand are required to follow each venue's health and safety incident protocols. Each guest seeking entry to an event on an MGM property represents and warrants that he/she is not required to quarantine or isolate as per CDC Guidelines, and shall not seek entry to a show if he/she is required to quarantine or isolate as of the show date. Guests understand, and agree, that such medical and health related information will be provided to and/or shared with Sponsor and/or its parent companies, affiliates, and subsidiaries as well as with third parties on a need-to-know basis. Sponsor reserves the right to modify the above requirements as the situation merits and in the event of changes to CDC Guidelines.

   As noted by government health officials, complete isolation from the COVID-19 virus or any other communicable disease is impossible. Accordingly, we cannot and do not promise to eliminate the risk of exposure to COVID-19 or any other communicable disease and cannot and do not promise that you will not contract COVID-19 or any other communicable disease. You acknowledge that we have informed you that our facilities are not risk-free, that it is possible that you may contract COVID-19 or any other communicable disease during your presence at our facilities, and that you freely choose to enter and/or reside in our facilities with awareness of the associated risks.

   Unless otherwise indicated herein, all expenses and travel costs including, but not limited to, all transportation, meals, incidental, surcharges, service charge or facility charges, personal charges at hotel, taxes or other expense, are the responsibility of each winner and his/her guest(s). Prizes are subject to availability, blackout days (which may include holidays, weekends and/or special events) and certain other restrictions. Limit one (1) prize per person. Unless otherwise indicated herein, all elements of a prize must be used in the same stay. Each guest of winner must be twenty-one (21) years of age or older, provided that the guest of a winner may be under the age of twenty-one (21) if the winner is the parent or legal guardian of such guest. If applicable, the prize is also subject to terms and conditions set forth in applicable prize certificate. The prize is non-transferable and no substitutions will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater retail value if the designated prize should become unavailable for any reason. The value of the prize set forth above represent Sponsor’s good faith determination of the ERV thereof, and the actual fair market value of the prize will be determined in Sponsor’s sole discretion, and will be final and binding and cannot be appealed. Actual value of prize may vary based on time of stay and other factors. Each winner is responsible for reporting and payment of all taxes and fees associated with prize receipt and/or use.

   No changes may be made by winner (or his/her guest(s)) to prize details once any portion of arrangements has been made. Sponsor is not responsible for changes in schedule of any element of the prize.

   Withdrawable Funds: Declared winners will be able to claim the withdrawable funds in their Sponsor account wallet 48 hours after responding to the winner selection notification with the required information within five (5) business days of the date and time notification was attempted by Sponsor. The withdrawable funds will not be subject to any wagering requirements and will not expire.

   Verified winners of the Weekly Prize Packages, and of the Grand Prize Package, will have until January 31^st , 2024 to book.. Hotel Stay is valid Friday February 9, 2024 through Monday, February 12, 2024.

   Estimated retail value (“ERV”) of each Weekly Prize Package is $4,000. ERV of Grand Prize Package is $9,000. Actual retail value (“ARV”) of prize may vary based on, among other things, winner's city of departure. Any difference between ERV and ARV will not be awarded. For any prize with an actual retail value (“ARV”) of six hundred dollars ($600) or greater, Sponsor will furnish an Internal Revenue Service Form 1099 to winner for the ARV of prize for the year in which prize was won.

   All details of prizes will be determined by Sponsor in its sole discretion. Prizes are subject to certain terms and conditions as specified by issuer. Restrictions may apply. Prizes are not redeemable for cash except in Sponsor’s sole and absolute discretion. All federal, state, and local taxes (including income and withholding taxes) and all other costs and expenses associated with acceptance and use of prizes not specified herein as being awarded are winner’s sole responsibility, including without limitation, ground transportation, luggage fees, meals, gratuities and souvenirs associated with the prizes.

   PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

   Sponsor reserves right to change dates. Hotel arrangements are subject to Promotion Entities’ approval, at their discretion, and must be made through Sponsor’s agent. Winner and guest (if any) must complete their hotel stay together on the same itinerary. Winner and guest (if any) are responsible for obtaining all necessary travel documents, including passports and visas (if applicable) prior to travel. In the event that the winner or his/her guest (if any) are unable to obtain a passport or visa prior to trip departure date outlined above the winner in question will forfeit the prize in its entirety and the prize may be awarded to an alternate potential winner at Sponsor’s sole and absolute discretion. Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize(s), and are not responsible or liable for any expenses incurred as a consequence thereof. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of winner and guest (if any). Winner and guest, if any, must comply with all applicable prize venue rules and regulations. Failure to do so may result in forfeiture of applicable prize element. Certain travel restrictions and blackout dates may apply. If winner chooses to redeem and/or participate in any portion of the prize with no guest, the remaining elements of the prize shall constitute full satisfaction of Sponsor’s prize obligations to winner and no additional compensation will be awarded. Prize is subject to certain terms and conditions as specified by issuer. Restrictions may apply. PRIZE DOES NOT INCLUDE ACCOMMODATIONS, PARKING, OR TRANSPORTATION BEYOND THAT DESCRIBED ABOVE.

7. RELEASE AND LIMITATION OF LIABILITY: By entering the Promotion, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Promotion Entities, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of the prize(s) or any portion thereof (including any travel related thereto); (b) to defend and indemnify Released Parties from any and all claims or liability resulting or arising from the Promotion and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize(s), including express warranties provided exclusively by prize provider that are sent along with the prize(s); (c) if selected as a Promotion winner, to the posting of such entrant’s name on the Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Terms & Conditions and to waive any right to claim any ambiguity or error therein or in the Promotion itself, and to be bound by all decisions of the Sponsor, which are binding and final.    Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, public health emergency, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control (“Force Majeure Event”). A Force Majeure Event expressly includes (i) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as “COVID-19”) or, (2) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.

PUBLICITY: Except where prohibited by law, by accepting a prize, each winner agrees and acknowledges that Sponsor and its designees may, without any limitation or further compensation, use his or her name, voice, biographical data and/or likeness in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for any commercial purpose including, but not limited to, advertising and promoting the Promotion or any other promotion, contest or Promotion sponsored by the Sponsor.
9. GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Promotion (or any portion of the Promotion) at any time without prior notice or consent for any reason, including, without limitation, should an error, virus, bug, computer problem or other cause or issue corrupt, restrict, prevent or inhibit the administration, security or proper operation of the Promotion and, in such situation, to select the potential winner from the remaining eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by Sponsor in its sole discretion. Sponsor may prohibit an entrant from participating in the Promotion or winning a prize if, in its sole discretion, Sponsor determines entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. No more than the stated number of prizes will be awarded. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Each entrant must be the rightful owner or have authorized use of the email account associated with the entrant’s submitted email address (if provided). If a dispute arises about who submitted an entry, the entry will be deemed submitted by the authorized account holder of the BetMGM Sportsbook account provided. The “authorized account holder” is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.
