THIS PROMOTION IS VOID WHERE PROHIBITED BY LAW, OR OTHERWISE RESTRICTED BY LAW. AFFIDAVIT OF ELIGIBILITY / RELEASE OF LIABILITY / PRIZE ACCEPTANCE AGREEMENT MAY BE REQUIRED. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

The BetMGM 10 Million Dollar Bracket Challenge promotion (the “Promotion”) is sponsored by BetMGM, LLC (“also known as the “Sponsor”), located at 100 King St West, 1 First Canadian Place, Suite 6200, Toronto, M5X 1B8. The terms “you” or “your” mean the person to whom a Promotion Payout (defined below) is issued to upon satisfaction of the terms and conditions set forth in this Promotion. Redemption of the Promotion is expressly conditioned upon acceptance of and compliance with all of these Promotion “Official Rules”. Promotion participants may be required to sign paperwork issued by the Sponsor.

1. Promotion Period: The Promotional entry period will begin on or around 5:00 p.m. ET on March 12th, 2023 and ends at 11:59 a.m. ET on March 16th, 2023 (the “Promotion Period”) before the start of the first tournament game.

2. Eligibility: The Promotion open only to legal residents of the province of Ontario, who are nineteen (19) of age or older at the time of entry (unless otherwise excluded by Sponsor in accordance with applicable law) and have an active, KYC verified BetMGM Sports Ontario account (“Sportsbook Account”). Proof of residency and age may be required. Creating a Sportsbook Account at www.betmgm.com is free. By submitting your information and creating a Sportsbook Account, however, you will be required to agree to Sponsor’s Privacy Policy and Terms of Service. If you do not agree to Sponsor’s Privacy Policy and Terms of Service, you cannot create a Sportsbook Account or participate in this Promotion. Employees, officers, directors, members, and representatives of Promotion Entities (defined below); members of these persons immediate families (spouse, parents, siblings, and children and each of their respective spouses, children, and siblings); and persons living in the same households of each of the above (whether legally related or not) are ineligible to participate in this Promotion or receive a prize. Sponsor additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Promotion for any reason, in its sole discretion, including based on your wagering patterns or wagering history. “Promotion Entities,” as referenced herein, shall include Sponsor and each of its parent, subsidiary, and affiliate companies; administrative, advertising, and promotion agencies, gaming license partners; and any other entity involved in the development, administration, promotion, or implementation of the Promotion. Subject to all applicable federal, state, provincial and local laws and regulations. Promotion is void outside of Ontario, and wherever prohibited or restricted by law.
3. How to Qualify: To qualify for the Promotion, eligible individuals must have an active, verified BetMGM Sports account (“Sportsbook Account”). Creating a Sportsbook Account at betmgm.com is free. By submitting your information and creating a Sportsbook Account, however, participants will be required to agree to the Privacy Policy and Terms. If you do not agree to Sponsor’s Terms and Privacy Policy, you cannot create a Sportsbook Account or participate in this Promotion. 

4. How to Enter:No Purchase Necessary to Enter or Win. During the Promotion Period, log into your Sportsbook Account and access BetMGM $10 Million Dollar Bracket Challenge entry page under the tab labelled “Promotions.” Then, follow the provided instructions to complete and thereafter submit your bracket (an “Eligible Bracket”). Any bracket submitted outside of the Promotion Period will not qualify as an Eligible Bracket. Limit one (1) Eligible Bracket per person/entrant. If entrant creates multiple brackets, the first submitted bracket (by timestamp, as determined by BetMGM in its sole discretion) will be the Eligible Bracket.

Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information, accounts or otherwise may result in the entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Promotion at Sponsor’s sole and absolute discretion. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. All materials submitted become the physical property of Sponsor and will not be returned. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the registered account holder of the email address associated with the entry for the domain associated with the submitted address provided that person is eligible. Winner(s) may be required to show proof of being the registered account holder. Registered account holder is defined as the person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. For purposes of this Promotion, an on-line entry is “received” when the Website’s servers record the entry information. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Promotion. The Website’s database clock will be the official timekeeper for this Promotion. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. All entrants submitting materials/content as part of the Promotion will be non-exclusively licensing (with the unlimited right to sublicense) to Promotion Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof.

1. Promotion Pay-out Determinations: 

$10,000,000 Perfect Bracket Prize

• Users will complete Eligible Bracket prior to start of first game on March 12th, 2023, and upon completion of tournament, if bracket is perfect, player will win grand prize of Ten Million Dollars. Perfect bracket is determined by correctly selecting each team to win through entirety of tournament from March 12th – March 16th, 2023 (the National Championship game).
  • First four games before the opening round do not count as correct or incorrect selections for the tournament.

$100,000 Guaranteed Prize For Highest Point Scorer

• User(s) who finish with the most correct picks throughout the entire tournament will win a guaranteed prize of One Hundred Thousand Dollars. The point system is determined by correctly select the winner of a game, per round, throughout the entirety of tournament from March 12th – March 16th, 2023.
  • All games throughout the tournament count as one point.
  • First four games before the opening round do not count as correct selections for the tournament.

2. Payout Amounts and Odds:

Users finishing with a perfect bracket will win a total pay-out of Ten Million Dollars ($10,000,000) (Promotion Payout).

In the event that there are two or more recipients that tie among results, the award of $10,000,000 will be evenly divided among the total number of winners, in Sponsor’s sole and absolute discretion. The approximate retail value of all the prizes awarded in this Promotion is $10,000,000. Limit of one prize per person.

One Hundred Thousand Dollar Guaranteed Prize (Promotion Payout).

In the event that there are two or more recipients that tie among the highest point total, the award of $100,000 will be evenly divided among the total number of winners who obtained the highest point total, in Sponsor’s sole and absolute discretion. The approximate retail value of all the prizes awarded in this Promotion is $100,000. Limit of one prize per person.

7. Promotion Payout: If applicable, the Promotion Payout will be deposited into users Sportsbook Accounts within seventy-two (72) hours of the conclusion of the Promotion, subject to verification of users’ eligibility, State specific requirements, and compliance with these Official Rules. Promotion Payout recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Payout received, regardless of whether the Promotion Payout, in whole or in part, is used. The Promotion Payout value is expected to be reported for tax purposes as required by law. The Promotion Payout is not transferable and cannot be substituted except in the Sponsor’s sole discretion. For any legally required winners’ list, send a self-addressed stamped envelope to Sponsor at 100 King Street West, 1 First Canadian Place, Suite 6200, Toronto, M5X 1B8. All such requests must be received within three (3) months after the end of the Promotion.

8. Administration: Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Promotion, and of selection of the winner(s). Decisions of the Sponsor as to the selection of the winner(s) will be final. The Sponsor expressly reserve the right to amend, suspend or terminate this Promotion at any time without prior notice or consent. Sponsor reserves the right to restrict at any time any Sportsbook Account holder from participating in this Promotion for any reason. Any questions relating to eligibility, these Official Rules or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and their decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Official Rules to their members.
9. Release and Waiver of Liability: By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, and each of their respective affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Payout, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence. The Sponsor expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Payout. In consideration of the Promotion Payout, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor, and each of their respective parents, subsidiaries and affiliates.
10. Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the applicable state, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
11. LIMITATION OF LIABILITY:

BY ENTERING THE PROMOTION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

13. Miscellaneous: No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
