BetMGM Canada Inc. (“Sponsor”) is offering Ontario Residents over the age of 21 the opportunity to win a Private Jet to Las Vegas. Package includes round-trip private jet transportation to and from Las Vegas, Nevada for the winner and five (5) guests, a three (3) night stay at the Bellagio Las Vegas with six (6) standard double occupancy rooms, and $10,000 CAD for additional expenses.

To enter:

• Visit takeatrip.ca from October 11, 2024, at 12:00 AM ET through November 10, 2024, at 11:59 PM ET.
• Once you have opted into the promotion, you will earn one (1) entry.

Private Jet to Las Vegas Grand Prize Package details:

PROMOTIONAL PERIOD

• This Sweepstakes is available to qualifying participants from October 11, 2024, at 12:00 AM EST through November 10, 2024, at 11:59 PM EST, unless terminated earlier in BetMGM’s sole discretion (the “Promotional Period”).
• Drawing will take place at least five (5) days after the conclusion of the Promotional Period. Sponsor’s computer is the official time-keeping device for the Sweepstakes.

ELIGIBILITY

• The Private Jet to Las Vegas (“Sweepstakes”) is open only to individuals who are legal residents of Ontario, Canda and who are twenty-one (21) years of age or older at the time of entry (unless otherwise excluded by Sponsor in accordance with applicable law (“Eligible Participant”). Employees, officers, directors, members and representatives of Sweepstakes Entities (defined below), members of these persons immediate families (spouse, parents, siblings and children and each of their respective spouses, children and siblings), and persons living in the same households of each of the above (whether legally related or not) are ineligible to participate in this Sweepstakes or receive a prize. Sponsor additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Sweepstakes for any reason, in its sole discretion, including based on your wagering patterns or wagering history. “Sweepstakes Entities,” as referenced herein, shall include Sponsor, MGM Resorts International Operations, Inc., and each of their respective parent, subsidiary, and affiliate companies, and administrative, advertising, and promotion agencies, gaming license partners, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes. Subject to all applicable federal, provincial and local laws and regulations. Sweepstakes is void outside Canada and wherever prohibited or restricted by law. This Sweepstakes is only open to natural persons and the following, as well as immediate family members (spouse, parents, siblings and children) and household members of each such person, are not eligible to participate in this Sweepstakes. The Sponsor reserves the right to verify the eligibility of all Participants. The Sponsor additionally reserves the right to refuse or otherwise restrict the eligibility of any individual to participate in this Sweepstakes for any reason, in its sole discretion, including based on Participant’s wagering patterns or wagering history.
• Additionally, any individual with a BetMGM account on any product in one (1) or more jurisdictions where the Sponsor operates, that has been involuntarily closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this Sweepstakes even where such entrant may seek entry in this Sweepstakes through an active account in another jurisdiction.
• Each entry received from an Eligible Participant that meets the above requirements will be considered an “Eligible Entry” and collectively referred to herein as the “Eligible Entries”.

ACTION REQUIRED

  Any attempt by any Participant to obtain more than the stated number of entries, including by using multiple/different, identities, registrations and logins, or any other methods, will void that Participant’s entries and that Participant may be disqualified from the Sweepstakes. Use of any automated system to participate is prohibited and will result in disqualification. Entries submitted by Participants who do not meet the eligibility requirements set forth in Section 2 above (including all requirements with respect to age and residence) are void. For purposes of this Sweepstakes, an online entry is received when Sponsor’s Website’s servers record the entry information, and a mail-in entry (if applicable), when such entry is physically received by Sponsor at the address provided herein. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes. The Website’s database clock will be the official timekeeper for this Sweepstakes. Those Participants who do not follow all of the instructions, provide the required information in their entry form, or abide by these Terms & Conditions or other instructions of the Sponsor may be disqualified. All Participants submitting materials/content as part of the Sweepstakes will be non-exclusively licensing (with the unlimited right to sublicense) to Sweepstakes Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof.

  General: All entries become the property of the Sponsor and, unless otherwise indicated herein, will not be acknowledged, or returned. Entries which are late, lost, stolen, mutilated, invalid, damaged, unreadable, tampered with, illegible, unintelligible, incomplete, misdirected, generated by a script, macro, or other automated/repetitive electronic means, that are mechanically reproduced, inaccurate, forged, and/or irregular in any way or otherwise not in compliance with these Terms & Conditions will be disqualified.

CLAIMING PROMOTIONAL OFFER

• TO PARTICIPATE IN THIS SWEEPSTAKES, PARTICIPANT MUST, DURING THE PROMOTIONAL PERIOD, ENTER THE SWEEPSTAKES IN A METHOD OUTLINED IN THE ABOVE SECTION.

• GRAND PRIZE: A total of one (1) Grand Prize Package is offered in this Sweepstakes (“Grand Prize Package”). This Grand Prize Package will be awarded to one (1) winner. This Grand Prize Package consists of the following elements:
  • $10,000 CAD for use towards travel expenses
  • Round-trip private jet from Toronto, ON to Las Vegas, Nevada for the winner and five (5) guests,
  • Three (3) night stay at Bellagio Las Vegas in Las Vegas Nevada for the Private Jet to Vegas Winner and five (5) guests with six (6) standard double occupancy rooms, plus daily resort fees. Verified winner and guests must complete their stay by Monday, March 31, 2025 and book within 14 days of check-in date.
• Estimated Retail Value (“ERV”) of Grand Prize Package is $80,000 CAD. Actual retail value (“ARV”) of prize may vary. Any difference between ERV and ARV will not be awarded.
• The verified Grand Prize winner will have the option to select a $50,000 CAD cash prize (“Alternate Prize”) in lieu of the Grand Prize Package. The Alternate Prize would be provided by check to the verified winner within thirty days (30) of confirmation that the verified winner selects the Alternative Prize.
• The elements of the Grand Prize Package are collectively known as the “Prizes”.

ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. CANCELLATION

• All amounts shown in this Sweepstakes are in CAD unless otherwise stated.
• This Sweepstakes cannot be used in conjunction with any other BetMGM promotion.
• Sponsor has complete discretion over interpretation of the Terms & Conditions, of administration and operation of the Sweepstakes, and of selection of the winner. Decisions of the sponsor as to the selection of the winner will be final and binding in all matters related to the Sweepstakes. The selected potential winner may, in sponsor’s sole and absolute discretion, be required to show a valid province-issued driver’s license, government-issued identification or other identification (subject to sponsor’s approval) as evidence of identity and/or residency. The sponsor expressly reserves the right to amend, suspend or terminate this Sweepstakes at any time without prior notice or consent. • By entering the Sweepstakes, each Participant agrees for Participant and for Participant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such Participant’s participation in the Sweepstakes and/or their acceptance, possession, use, or misuse of the Prize(s) or any portion thereof (including any travel related thereto); (b) to defend and indemnify Released Parties from any and all claims or liability resulting or arising from this Sweepstakes and the acceptance, use, and participation in any Prize, and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize(s), including express warranties provided exclusively by the prize provider that are sent along with the Prize(s); (c) if selected as winner of this Sweepstakes, to the posting of such Participant’s name on the Sweepstakes Entities’ websites, social media accounts and/or mobile applications and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Terms & Conditions and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsor, which are binding and final. • Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), ordinances(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action[s], regulations[s], order[s] or request[s] prove[s] to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, pandemic, public health emergency, severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond sponsor’s sole control (Force Majeure Event). A Force Majeure Event expressly includes (1) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as COVID-19) or, (2) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.
• Released Parties are not responsible for and shall not be liable for: (i) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a Participant’s ability to take part in the Sweepstakes; (iii) unauthorized human intervention in any part of the entry process of the Sweepstakes; (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (v) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, undeliverable, damaged or stolen entries or notices (including winner notifications, if applicable); (vi) data corruption, theft, destruction, unauthorized access to or alternation of entry or other materials; (vii) any printing, typographical, human, administrative or technical errors or omissions in any material associated with the Sweepstakes; and/or (viii) any injury, loss, costs, expenses or damages to persons or property (including, but not limited to, damage to any computer system or mobile device related to participation in, accessing or downloading information related to the Sweepstakes) which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Sweepstakes or any Sweepstakes related activity; and/or (ix) any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any persons.

• Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) for any reason, including, without limitation, should an error, virus, bug, computer problem or other cause or issue corrupt, restrict, prevent or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation, to select the winner from the remaining eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by Sponsor in its sole and absolute discretion. Sponsor may prohibit a Participant from participating in the Sweepstakes or winning the prize if, in its sole and absolute discretion, Sponsor determines a Participant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other Participant or Sponsor’s representatives. No more than the stated number of prizes will be awarded. • This Sweepstakes is intended for viewing in the Ontario, Canada only and shall be construed and evaluated only according to Canadian law. Do not enter this Sweepstakes if you are not located in Ontario, Canada and, more specifically, comply with eligibility requirements set forth herein. The use of any automated devices in connection with this Sweepstakes is prohibited. Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transactions, or network connections, whether human, technical, or otherwise in nature. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, or other causes beyond its control corrupt the administration, security, or proper play of this Sweepstakes. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of Entry. In the event of a dispute, the Potential Winner may be required to provide proof that he or she is the authorized holder of the identified e-mail account.
• The invalidity, illegality, or unenforceability of any provision of these Terms & Conditions shall in no way affect the validity, legality, or enforceability of any other provision hereof. Any invalid, illegal, or unenforceable provision shall be deemed severed from these Terms & Conditions and the balance of these Terms & Conditions shall be construed and enforced as if these Terms & Conditions did not contain such invalid, illegal, or unenforceable provision.

All such requests must be received within three (3) months after the end of the Promotional Period.

WINNER’S SELECTION AND NOTIFICATION

• The drawing for the Promotional Period will take place at least five (5) days after the conclusion of the Promotional Period. One (1) potential winner will be selected in a random drawing by representatives of Sponsor from among all eligible entries received during the Promotional Period. The odds of winning the Grand Prize depend upon the total number of eligible entries received for the Grand Prize drawing. Selected potential winner will be notified via email and/or telephone.
• In order to win, the selected potential winner must correctly answer, unaided, an arithmetical, time-limited, skill testing question.
• Sponsor is not obligated to leave a voice recording or other message if the potential prize winner does not answer Sponsor’s telephone call. The selected potential winner will be required to respond to the notification with the required information within five (5) business days of the date and time notification was sent/attempted by the Sponsor, or the Prize will be forfeited. To receive the Prize, the selected potential winner must continue to comply with these Terms & Conditions and fulfill all requirements set forth herein.
• Selected potential winner may be required to sign and return an Affidavit of Eligibility, Liability, & Publicity Release (“Affidavit”) and a Canadian W8BEN, Canadian T4A, IRS Form W-9, and/or IRS Form 1099 (if applicable) to Sponsor. If required by Sponsor, these documents will be sent out to the potential winner by email along with instructions on to how to return them to Sponsor. In addition, potential winner’s guests, if any and as applicable, may (in Sponsor’s sole discretion) be required to execute and return a release of liability as directed in order to participate in the prize as winner’s guests. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of any alternate winner. Sponsor may share potential winner’s name and contact information with Sweepstakes Entities and/or any prize provider, as applicable, if necessary. Upon completion and acceptance of the Affidavit, and once a potential winner provides the necessary proof of travel documents, if any, then he or she will be declared the winner.
• In order to be verified as a winner and receive the Prize, potential winner must be in good standing with MGM Resorts and Sponsor including without limitation being current on all accounts and not previously excluded from any properties or services, and not be excluded under any applicable state regulations. Potential winner and all guests must be willing to voluntarily submit to and complete a background check as a condition of continued eligibility.
• PLEASE NOTE THAT EVEN IF YOU OR YOUR ENTRY IS IDENTIFIED AND/OR CONTACTED AS A POTENTIAL WINNER AT THE CLOSE OF THIS SWEEPSTAKES, YOU HAVE NOT YET WON A PRIZE. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND MUST MEET ALL ELIGIBILITY REQUIREMENTS AND THE TERMS OF THESE TERMS & CONDITIONS BEFORE A PARTICIPANT WILL BE CONFIRMED AS A WINNER AND A PRIZE WILL BE AWARDED.
• The selected potential winner may be disqualified (and may forfeit the prize) if such selected potential winner (i) is unreachable or does not timely respond to any communication from Sponsor (or its designee) (or if a winner notification is returned as undeliverable), (ii) declines or cannot accept, receive or use the Prize for any reason, (iii) fails to sign and return Affidavit within the required time period, and/or (iv) does not comply with these Terms & Conditions. In the event that a selected potential winner is disqualified and/or is unable to satisfy the requirements herein, Sponsor will use reasonable efforts to award the Prize to an alternate winner selected from among the remaining eligible entries (if necessary and time permitting) who successfully meets the requirements to receive the Prize, but Sponsor reserves the right to not award the Prize if Sponsor is unable to identify an eligible alternate winner (if any) to accept the Prize.

PRIZES

• Winner will be required to present a valid government-issued photo identification and valid credit card at the time of check-in to cover incidentals and fees/services not included in the prize. Verified winner must complete their stay by Monday, March 31, 2025 and book within 14 days of check-in date.
• The round-trip air transportation element of the prize (if applicable) is valid for travel that begins and ends at the initial point of departure, Toronto, ON. Winner and his/her guests must travel together on the same itinerary, including the same departure date, destination and return date. Winner and his/her guests may be responsible for obtaining their own transportation to and from the point of departure. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance to prize destination, as determined by Sponsor in its sole discretion, and to award no additional compensation or substitution for the difference in prize value. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by airline/transportation companies. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of ground transportation delay.
• Prizes received from this Sweepstakes are non-transferable and are subject to availability (as determined by Sponsor in its sole discretion).

  The verified Grand Prize winner will have the option to select a $50,000 CAD cash prize (“Alternate Prize”) in lieu of the Grand Prize Package. The Alternate Prize would be provided by check to the verified winner within thirty days (30) of confirmation that the verified winner selects the Alternative Prize.

• Verified winner of the Grand Prize Package must complete their stay by Monday, March 31, 2025 and book within 14 days of check-in date, or select the Alternate Prize.
• ERV of Grand Prize Package is $80,000 CAD. Actual retail value (“ARV”) of prize may vary based on, among other things, winner's city of departure. Any difference between ERV and ARV will not be awarded.
• Guests who have a positive COVID-19 test while at an MGM property are required to follow such MGM property’s health and safety incident protocols. EACH GUEST SEEKING ENTRY TO an MGM property represents and warrants that he/she is not required to quarantine or isolate as per CDC Guidelines, and shall not seek entry to an event if he/she is required to quarantine or isolate as of the event date. Guests understand, and agree, that such medical and health related information may be provided to and/or shared with Sponsor and/or MGM Resorts International and/or each of their respective parent companies, affiliates, and subsidiaries as well as with third parties on a need-to-know basis. Sponsor and MGM Resorts International reserves the right to modify the above requirements as the situation merits and in the event of changes to CDC Guidelines.
• As noted by government health officials, complete isolation from the COVID-19 virus or any other communicable disease is impossible. Accordingly, Sponsor and MGM Resorts International cannot and do not promise to eliminate the risk of exposure to COVID-19 or any other communicable disease and cannot and do not promise that you will not contract COVID-19 or any other communicable disease. You acknowledge that Sponsor and MGM Resorts International have informed you that our facilities related to the prize are not risk-free, that it is possible that you may contract COVID-19 or any other communicable disease during your presence at our facilities, and that you freely choose to enter and/or reside in our facilities with awareness of the associated risks.
• Winner will be required to present a government-issued photo ID and major valid credit card at the time of hotel check-in to cover incidentals and fees/services not included in the prize. Any additional charges will be the responsibility of the winner at the time of check-out and will be applied to the credit card on file.
• All details of prizes will be determined by Sponsor in its sole discretion. Prizes are subject to certain terms and conditions as specified by issuer. Restrictions may apply. Prizes are not redeemable for cash except in Sponsor’s sole and absolute discretion.
• Unless otherwise indicated herein, all expenses and travel costs including, but not limited to, all transportation, meals, incidental, surcharges, service charge or facility charges, personal charges at hotel, taxes or other expense, are the responsibility of each winner and his/her guest(s). Prizes are subject to availability, blackout days (which may include holidays, weekends and/or special events) and certain other restrictions. Limit one (1) prize per person. Unless otherwise indicated herein, all elements of a prize must be used in the same stay. Each guest of winner must be twenty-one (21) years of age or older. If applicable, the prize is also subject to terms and conditions set forth in applicable prize certificate. The prize is non-transferable and no substitutions will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater retail value if the designated prize should become unavailable for any reason. The value of the prize set forth above represent Sponsor’s good faith determination of the ERV thereof, and the actual fair market value of the prize will be determined in Sponsor’s sole discretion, and will be final and binding and cannot be appealed. Actual value of prize may vary based on time of stay and other factors. Each winner is responsible for reporting and payment of all taxes and fees associated with prize receipt and/or use.
• Personal information of winner receiving Private Jet to Las Vegas Grand Prize Package, including name and contact information, will be provided to MGM and Air Charter Service Privacy Policy for prize fulfillment purposes. Personal information of winner will be subject to MGM’s Privacy Policy and Air Charter Service Privacy Policy.
• Personal information including name, address and phone number of winner and their guests, Private Jet to Las Vegas Grand Prize Package including name and contact information, will be provided to MGM Resorts International ( "MGM") and Air Charter Service Privacy Policy for prize fulfillment purposes if the Private Jet to Las Vegas Grand Prize Package is selected. Personal information of winner and their guests will be subject to MGM’s Privacy Policy and Air Charter Service Privacy Policy.
• PRIZE DOES NOT INCLUDE ACCOMMODATIONS, PARKING, OR TRANSPORTATION BEYOND THAT DESCRIBED ABOVE.
• TRAVEL MUST TAKE PLACE ON THE DATES SPECIFIED BY SPONSOR AT ITS SOLE DISCRETION OR PRIZE WILL BE FORFEITED. TRAVEL COMPANIONS MUST BE 21+. THE POTENTIAL WINNER AND THEIR TRAVEL COMPANIONS WILL BE REQUIRED TO EXECUTE A RELEASE OF LIABILITY PRIOR TO TRAVEL. • Sponsor reserves right to change dates. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of prize destination, as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Winner and guest (if any) must travel together on the same itinerary. The winner’s guests (if any) must be twenty-one (21) years of age or older at the time of winner notification. Winner and guests (if any) are responsible for obtaining all necessary travel documents, including passports and visas (if applicable) prior to travel. In the event that the winner or his/her guests (if any) are unable to obtain a passport or visa prior to trip departure date outlined above the winner in question will forfeit the prize in its entirety and the prize may be awarded to an alternate potential winner at Sponsor’s sole and absolute discretion. Failure to do so may result in forfeiture of applicable prize element. Certain travel restrictions and blackout dates may apply. Sponsor is not responsible for changes in schedule of any element of the prize. If winner chooses to redeem and/or participate in any portion of the prize with no guests, the remaining elements of the prize shall constitute full satisfaction of Sponsor’s prize obligations to winner and no additional compensation will be awarded. • No changes may be made by the winner (or their guests) to the Prize details once any portion of arrangements has been made.
• Notwithstanding anything to the contrary herein, stated on-air, published online, or otherwise communicated to a potential winner, no potential winner of will be entitled to receive the Prize until Sponsor has verified such potential winner’s eligibility and compliance with these Terms & Conditions and until such potential winner has completed and submitted all documents required by Sponsor.
• In order to receive the Prize, winner may be required to (i) present a valid photo identification issued by a commonwealth, state, or territory of Canada or by the Canadian government; (ii) sign and return an Affidavit of Eligibility, Liability, & Publicity Release (“Affidavit”) and a Canadian W8BEN, Canadian T4A, IRS Form W-9, and/or IRS Form 1099 (if applicable) to Sponsor. If required by Sponsor, these documents will be sent out to the potential winner by email along with instructions on to how to return them to Sponsor. • Disputes regarding these Terms and Conditions or any other issues arising from the Sweepstakes will be governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. Any and all legal actions, claims, proceedings or litigation arising in connection with the Sweepstakes shall be adjudicated in the judicial district of Toronto, province of Ontario, and the parties consent to such exclusive venue and jurisdiction.
